Is there a rule, that if your ditch lights don't flash you can't go over 20 mph?

Flashing ditch lights is more of an NS/CSX/Amtrak thing, which has spread mostly through retirements by those roads, which end up on shortlines and regionals. BNSF, UP, CN (and CP?) don't order or install flashing ditch lights.

CSX and NS are the only Class 1s that regularly use flashing ditch lights, but even they have some engines where the ditch lights aren't wired to flash. BNSF also has some former BN SD70MACs that have a selection on the headlight switch that will make the ditch lights flash if the engineer desires. I'm sure there are others I'm unaware of.

It doesn't matter if they flash or not, they just have to be on over the crossing.
